Terms of Service
This document is the public offer (Terms of Service) for using the HamikVPN service. By creating an account, starting the free trial, or paying for a subscription, you accept these terms in full.
1. About the service and the provider
HamikVPN (the "service", "we") is a self-hosted VPN service operating at hamik.site, through the HamikVPN mobile app, the user dashboard and the Telegram bot. The service is run by an individual, not a registered company or legal entity — HamikVPN is a personal project, not the offering of a registered business. There is no company name, registration number or VAT ID because none exists; contracting with us means contracting with the individual operator directly, as described in section 12 below.
This document is a public offer within the meaning generally used for such offers: by using the paid features of the service, you accept these terms and enter into an agreement with us on these terms, without a separate signed contract being required.
2. What the service provides
HamikVPN provides paid access to a VPN — encrypted tunnelling of your device's internet traffic through servers we operate, on the AmneziaWG protocol (an obfuscated fork of WireGuard). Depending on the plan you choose, this includes: one or more device keys, access to the available VPN servers shown in the app and dashboard, and a data allowance and speed as described for your plan on the pricing page. We may add, remove or relocate servers, and may change technical parameters of the service (protocol settings, server list, app versions) to keep it working and secure; we try to do this without disrupting active connections.
New accounts receive a 3-day free trial with no payment card required. The trial is provided at our discretion and may be limited or withdrawn to prevent abuse (for example, repeated trial signups from the same person).
3. Payment
Paid subscriptions are billed in advance for a period you choose (for example, one month, six months or a year) at the price shown in the dashboard, in the app, or on the pricing page at the time of purchase. Payment is processed by our payment provider, Platega; we do not receive or store your card details — see the Privacy Policy for details on payment data.
You can pay directly in the dashboard or through our Telegram bot. Prices may be shown in different currencies (for example RUB or EUR) depending on your locale; the currency and amount charged are those confirmed at checkout.
We do not automatically charge your card for renewal. Each payment is a one-time charge for the period you select; there is no recurring auto-billing unless a specific payment method you use explicitly enables it and you have agreed to that separately with the payment provider. Prices may change for future periods; a change in price does not affect a period you have already paid for.
4. Subscription term and renewal
A paid subscription is active for the period you purchased, starting from a successful payment (or from the end of an active trial or previous paid period, if you renew before it ends). You can see the exact expiry date of your subscription in the dashboard at any time.
When a subscription or trial expires, your device keys stop being able to connect to the VPN servers; your account and its data are not deleted. To keep using the service, renew your subscription in the dashboard or via the Telegram bot before or after expiry — there is no penalty for renewing late, but there is a gap in service between expiry and the new payment.
We may, at our discretion, extend a user's access for free (for example, as compensation for an outage or as part of a promotion). Such extensions do not create an obligation to repeat them in the future.
5. Refunds
Because the free trial lets you test the service before paying, and because VPN access is consumed as soon as it is provided, paid periods are generally non-refundable once the payment succeeds. If the service was unavailable to you for a significant, continuous period due to a fault on our side (not due to your device, network, or local blocking of VPN traffic), contact support — we consider refunds or free extensions on a case-by-case basis and will act in good faith.
6. Acceptable use
You may use HamikVPN for lawful personal purposes: private browsing, bypassing arbitrary network restrictions, protecting your traffic on untrusted networks, and similar uses. You agree not to use the service to:
- commit or facilitate any illegal activity under the laws applicable to you, including fraud, unauthorised access to systems, distribution of malware, or infringement of others' rights;
- send spam, run denial-of-service attacks, or otherwise abuse or attack third-party networks and services through our infrastructure;
- distribute child sexual abuse material or any other content that is illegal to distribute;
- resell, sublicense or share your access in a way that circumvents the plan and device limits you paid for;
- attempt to disrupt, overload or reverse-engineer the service's infrastructure in a way that harms other users.
We do not monitor or log the content of your traffic (see the Privacy Policy), so we generally cannot proactively detect a violation of this section from traffic content alone. However, if we receive a credible abuse report, a valid legal request, or detect abuse from connection metadata (for example, an attack pattern), we may investigate and take action under section 7.
7. Suspension and termination
We may suspend or terminate your access, with or without a refund of any remaining paid period, if: you violate section 6; you attempt to defraud the payment system (chargebacks, stolen cards); your use meaningfully harms the service or other users; or we are required to do so by applicable law. Where practical, we will try to notify you of the reason via the contact details on your account.
You may stop using the service and delete your account at any time from the dashboard or by asking support; this does not entitle you to a refund of an already-paid period unless section 5 applies.
8. Service availability and limitation of liability
We run HamikVPN as a small, self-hosted operation and do our best to keep it available, fast and secure, but we do not guarantee uninterrupted or error-free operation. Servers may be temporarily unavailable due to maintenance, upstream network issues, attacks, or actions of third parties (including network operators who block VPN protocols) that are outside our control.
To the maximum extent permitted by applicable law: the service is provided "as is", without warranties of any kind, express or implied; we are not liable for indirect, incidental or consequential damages, or for loss of data, profit or opportunity arising from your use of or inability to use the service; and our total liability for any claim relating to the service is limited to the amount you paid us for the subscription period during which the issue occurred. Nothing in this section limits liability that cannot be limited under applicable law.
You are responsible for how you configure your device and for complying with the laws of the country you are in, including any local rules on the use of VPN software — we do not provide legal advice on this and cannot guarantee that using a VPN is unrestricted in every jurisdiction.
9. Changes to the service and these terms
We may update these terms — for example, if pricing, plans, or the legal or operational setup of the service changes. The current version is always available at this page; the "last updated" date is shown at the top. Material changes will, where practical, be announced through the Telegram channel or by email/in-app notice. Continued use of the service after a change takes effect means you accept the updated terms; if you do not agree, you may stop using the service and, where applicable, request cancellation under section 5.
10. Intellectual property
The HamikVPN name, logo, website and app design, and the underlying software we operate, belong to us or our licensors. This document gives you a right to use the service for your own personal purposes — it does not transfer ownership of, or a licence to redistribute, our software, brand or content.
11. Governing terms
These terms are intended to be read in plain, reasonable language rather than as a reference to a specific national legal system, since the service is offered by an individual operating internationally rather than through a registered company in a single jurisdiction. If any part of these terms is found unenforceable under the law that applies to you, the rest remains in effect, and we will interpret the unenforceable part in a way that is closest to its original intent. Nothing here removes any statutory right you have as a consumer that cannot be waived under the law that applies to you.
